ORDER

(Order of the Court was made by C.T.SELVAM, J.) The Writ Petitioner seeks issuance of a Writ of Mandamus, directing the respondent to conduct the temple festival of Sree karuppana Samy and Sree Rakkayee Amman Temple at Keelrangiyam Village, Thiruppuvanam Taluk, Sivagangai District, from 11.07.2018 to 14.07.2018, by inviting all the villagers to participate in the temple festival without there being any discrimination on the basis of order passed by this Honble Court in W.P.(MD) No. 13181 of 2017 dated 18.07.2017.

2.Heard the learned counsel for the petitioner; learned Special Government Pleader for the respondents 1 to 4 and the learned counsel appearing for the respondents 5 and 6. 3.The learned counsel for the petitioner submitted that it is only the fifth respondent, who is not joining the other villagers in joint conduct of the festival and that it is nobody's intention to exclude the members of the fifth respondent group. 4.The learned counsel for the fifth respondent submitted that persons belonging to his group are excluded and that the fifth respondent group is also willing to join others in common conduct of the festival.

5.All the counsel are agreed that they would abide by the directions of this Court in W.P.(MD)No.13181 of 2017, dated 18.07.2017. We reproduce the same hereunder:- "3.It appears that the villagers of Panayanenthal Colony were ignored. Today, the representatives of three villages are present along with poosari. Thiru A.Manikandeswaran, Sub Inspector of Police, Palayanoor Police Station, Sivagangai District, is also present. It is agreed that the festival would be amicably and peacefully celebrated from 19.07.2017 to 22.07.2017, by inviting members of Panayanenthal Colony also. First respect would not be accorded to any particular group. All the three villagers would be equally represented during the festival.

4.The Sub Inspector of Police, Palayanoor Police Station, Sivagangai District, is specifically directed to ensure that what has been agreed upon before this Court should be adhered to scrupulously during the celebration of the festival and if there is any violation, it is always

open to the police to take appropriate action in accordance with law. In case there is any violation, proceedings for contempt will be initiated against the erring persons." 6.Reiterating the duty placed upon the fourth respondent in the earlier order, this writ petition shall stand closed, as no further specific directions, than those contained in the earlier order, are necessary. No costs.
