Respondents PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the third respondent police not to harass the petitioner and his wife pertaining to the property dispute between the partners of M/s.Om Muruga Chambers at S.No.242/2A1 Melakaraipatti Village, Palani Taluk, Dindigul District, to an extent of 9 acres 60 cents based on the petitioner's complaint, dated 02.06.2020.

ORDER

This petition has been filed seeking direction to the third respondent police not to harass the petitioner and his wife pertaining to the property dispute having between the partners of M/s.Om Muruga Chambers.

2.The learned counsel appearing for the petitioner would submit that the respondent police harassed the petitioner under the guise of enquiry.

Crl.O.P.(MD)No.8790 of 2020 3.The learned Government Advocate appearing on behalf of the respondents 1 to 3, on instructions, would submit that there is no complaint has been received against the petitioner till now. However, the petitioner himself lodged a complaint against the fourth respondent and the same was received by the third respondent and upon which, enquiry has been initiated in CSR.No.97/2020 and the same was pending on the file of the third respondent police.

4. Hence, it is made clear that since the petitioner is a complainant, the respondents police shall not call the petitioner in the guise of enquiry and harass him.

5.With the above observations, this Criminal Original Petition is closed.
