Prayer: Criminal Original Petition filed under Section 482 of Cr.P.C., praying to direct the learned Special Court for Prevention V & AC Act cases, Madurai to expedite the trial in Spl.C.C.No.32 of 2014 and dispose of the same within the time stipulated by this Court.

O R D E R

The accused in the special case in Spl.C.C.No.32 of 2014 on the file of the learned Special Judge for Prevention of V&AC Act Cases, Madurai, seeks a direction for expeditious trial of the case.

2. In this case, process of examining prosecution witnesses has started. PW.1 has been examined, who had spoken about his sanctioning of this prosecution. Now the case is posted to a future date for production of further witnesses.

3. This case is of the year 2014. The right to speedy trial and speedy justice has become part of one's fundamental right, under Article 21 of Constitution of India. An accused is also entitled to know the result of the case quickly. It has twin objectives. An innocent will be freed quickly from the case and the guilty will be dealt with appropriately at an early date.

4. Now in Madurai, there is a Special Judge under P.C.Act, exclusively to deal with cases under P.C.Act. So, the Special Judge does no work except this work. Unlike in other Criminal Courts, workload in these exclusive Special Courts are very less. The Special Judges have lot of time at their disposal.

5. I am satisfied that the present case in the said Special Court is moving at a snail's pace. No appreciable progress has been achieved. So, the trial process must be accelerated. https://hcservices.ecourts.gov.in/hcservices/

6. In the circumstances, the learned Special Judge, under Prevention of V & AC Act, Madurai, is directed to dispose of the special case in Spl.C.C.No.32 of 2014, within three months from the date of receipt of a copy of this order. The Special Judge shall direct the prosecution to produce the witnesses promptly. It is made clear that both the Special Prosecutor as well as the learned defence counsel will co-operate with the learned Special Judge in disposing of the case within the prescribed time.

7. Accordingly, this Criminal Original Petition is disposed of.
