ORDER : The Court Made the following order :- The petitioner is arrayed as sole accused, who was arrested and remanded to judicial custody on 01.04.2016 for the alleged offences punishable under Section 302 of IPC, in Crime No.138 of 2016, on the file of the respondent police and hence, seeks bail. 2.The case of the prosecution is that the petitioner and the deceased are husband and wife. On 31.03.2016, the deceased was found dead. On complaint, initially a case has been registered under Section 174 Cr.P.C. On 01.04.2016, the petitioner was arrested by the respondent police and he confessed that he killed his wife and thereafter, the charges were altered into Section 302 of IPC. 3.The case of the petitioner is that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. There is no motive for the petitioner to murder his wife and even three days prior to the occurrence, he brought the deceased to her mother's house. He was arrested only on his confession.
4.The learned Government Advocate(Crl.side) submitted that the petitioner is a Alcoholic and he used to quarrel with the deceased often and he pledged the jewels of the deceased. Due to that, a dispute arose between the petitioner and the deceased. On the date of occurrence, the petitioner assaulted the deceased and dashed her https://hcservices.ecourts.gov.in/hcservices/
head on Wall and pressed the pillow on the face of the deceased and murdered him. Investigation is pending.
5.Considering the facts and circumstances of the case and also considering the fact that the petitioner is in judicial custody from 01.04.2016, this Court is inclined to enlarge the petitioner on bail with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned District Munsif-cum-Judicial Magistrate, Vadipatti and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders.
