Considering the fact that the condition imposed by this Court directing the petitioner to surrender the passport before the respondent is within the purview of the authorities concerned under Sections 10(1) and 10(A) of passport Act and the above condition imposed by this Court is onerous and the same alone is set aside.

4. This Criminal Miscellaneous Petition is modified accordingly.
