For Respondent : A.Albert James, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No.1104/2021 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 457 and 380 of IPC in Crime No.1104 of 2021, on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner and the other accused persons entered into the defacto complainant's house and have stolen gold jewels, silver ornaments, other household articles and Saudi Riyal worth about Rs.50,000/- in Indian value and Rs.20,000/- of Indian money. Hence the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner did not commit any offence as alleged by the prosecution and based on the confession of the co-accused, the petitioner was arrayed as the sixth accused.
4.The learned Government Advocate(Crl.side) appearing for the respondent police would submit that apart from this case, there is https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.9032 of 2022 one previous case registered against the petitioner under Section 302 of IPC.
5.Considering the facts and circumstances of the case and also considering the fact that some of the stolen articles are not yet recovered, this Court is not inclined to grant anticipatory bail to the petitioner.
