Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 506(ii) and 379(NH) of IPC, in Crime No.242 of 2016, on the file of the respondent police and hence, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner, who is the wife of one Ashok Kumar an Advocate, entered into the office of her husband and attempted to attack him and abused him in filthy language and taken away Rs.25,000/- from his office. 3.The case of the petitioner is that the petitioner is an innocent and she has not committed any offence as alleged by the prosecution. The petitioner has given a complaint against her husband and the has been registered in Cr.No.19 of 2015 for the punishable under Sections 498(A), 494, 294(b) and Section 4 of Women Harassment Act. At the instigation of her husband, the defacto complainant has given a false complaint against her. 4.Heard the learned Government Advocate(Crl.side). 5.Considering the facts of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the https://hcservices.ecourts.gov.in/hcservices/
event of arrest or on her appearance before the learned Judicial Magistrate No.I, Ramnad and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
