PRAYER :- For Bail in Crime No. 96 of 2018 on the file of the respondent police ORDER : The Court made the following order :- The petitioner herein was arrested and remanded to judicial custody on 02.10.2018 for the alleged offence under Section 8(c) r/w 20(b)(ii)(C), 25, 27(A) and 29(1) of NDPS Act, in Crime No.96 of 2018.

2. The case of the prosecution is that the petitioner along with co-accused were found in possession of 5-Nos plastic bag weighing each 20Kg in the car bearing Regn No.KL-29-K-7640. Hence, the crime was registered.

3. Today, when the matter is taken up for hearing, the learned counsel appearing for the petitioner fairly submitted that, after completing investigation the respondent police has filed charge sheet and the same has been taken cognizance in C.C.No. 189 of 2019 https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.8810 of 2020 on the file of the Principal Special Judge for EC & NDPS Act Cases, Madurai and in this case trial has been commenced and except the Investigating Officer all other witnesses were examined. He also seeking direction to the Court below for speedy disposal.

4. The learned Additional Public Prosecutor appearing for the respondent police would submit that trial has also been commenced and only the Investigating Officer has to be examined.

4. Considering the facts and circumstances of the case, the trial has already been commenced and at this stage, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, the Criminal Original Petition stands dismissed. However, the learned Principal Special Judge for EC & NDPS Act Cases, Madurai is directed to dispose the case in C.C. No. 189 of 2019, within a period of Two Months from the date of receipt of a copy of the order.
