Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents, more particularly the 2nd respondent to release and grant salary and allowances to the petitioners from 28.02.2022 viz., their date of appointment as Lab Assistants in accordance with the proceedings of the 3rd respondent in Pa.Ma.No.2764/E3/2022 dated 03.08.2022.

ORDER

By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

2. This writ petition is filed for Writ of Mandamus, directing the respondents to release the grant salary and other allowances to the petitioners, from the date of their appointment as Lab Assistant etc.

3. The 4th respondent is the private aided minority institution. The post was sanctioned by the respondents and the College was allowed to fill the post. Based on the permission, the College has recruited the petitioners. But the respondents have not issued grant in aid to the petitioners from the date of appointment, inspite of the College submitting the proposal. Therefore, this Court without expressing any opinion, the 2nd and 3rd respondents are directed to consider and pass orders.

4. The contention of the petitioners is the 3rd respondent has already approved the proposal and the proposal is pending before the 2nd 2/4

respondent. Therefore, the 2nd respondent is directed to consider and pass orders within a period of 8 weeks from the date of receipt of a copy of the order.

5. With these observations and directions, this Writ Petition is allowed. No Costs.
