PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to direct the 2nd respondent police not to harass the petitioner on the guise of investigation in connection with the case in Crime No.868 of 2025 on the file of respondent Police on basis of the petitioner's representation dated 04.02.2025. ORDER
The present petition has been filed seeking a direction as against the second respondent police not to harass the petitioner under the guise of enquiry relating to an FIR in crime No.868 of 2025.
2. According to the learned Counsel appearing for the petitioner, she was arrested and let out on bail by this Court in Crl.O.P(MD)No.22580 of 2025, dated 10.12.2025. As per the directions of this Court, the petitioner has reported to the concerned police daily at 10.30 a.m., for a period of two weeks and thereafter, she was directed to appear before the police as and when required for investigation.
3. It is the grievance of the petitioner that everyday the petitioner is being called by the police officials without any summons and being made to wait from morning to evening.
4. Per contra, the learned Government Advocate(crl.side) appearing for the respondents submitted that the petitioner is an accused in crime No.868 of 2025 and therefore, the petitioner is being called for investigation. 2/4
5. Considering the submissions made on either side, there shall be a direction to the second respondent police to issue summons to the petitioner as and when the petitioner is required for investigation. Without issuing summons, the petitioner shall not be called for any further enquiry.
6. With the above said observations, this Criminal Original Petition stands closed.
