ORDER
O.S.No.15 of 2017 was filed by the petitioners herein / plaintiffs, before the District Munsif, Theni, against the respondent herein / defendant for the relief of mandatory injunction, to hand over the documents which were submitted before the respondent / defendant. The grievance of the petitioners is that though the respondent / defendant entered appearance and filed their written statement as early as on 20.09.2017, issues were not framed, till date, with the result, the suit is still pending. Therefore, the petitioners / plaintiffs, being senior citizens, are before this Court seeking a direction to the Court below for early disposal of O.S.No.15 of 2017.
2. Heard the learned Counsel appearing for the petitioners / plaintiffs. Notice to the respondent / defendant is dispensed with, since the prayer sought for in this civil revision petition is for early disposal of the suit proceedings.
3. Perusal of record would fortify the submission made by the learned Counsel for the petitioners / plaintiffs that though written statement was filed on 20.09.2017, the matter is continuously adjourned for framing issues.
4. Under such circumstances and also considering the limited scope of the relief sought for as well as the age of the petitioners / plaintiffs, this Court, without going into the merits of the case, directs the learned District Munsif, Theni, to dispose of O.S.No.15 of 2017, on merits and in accordance with law, within a period of six months from the date of receipt of a copy of this order. https://hcservices.ecourts.gov.in/hcservices/
5. With the above direction, the civil revision petition is disposed of. No costs.
