Prayer: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorarified Mandamus to call for the records pertaining to Impugned Refusal Check slip in RFL/Kottaram/28//2026 dated 06.03.2026 on the file of Respondent No. 2 and quash the same as illegal and consequently direct the Respondent No.2 to register the Sale deed dated 06.03.2026 presented by the petitioner within the time limit stipulated by this Court and pass such further or other orders as this Honble court may deem fit and proper in the circumstances of this case and thus render justice.

ORDER

The present writ petition has been filed to quash the impugned refusal check slip dated 06.03.2026 and consequently direct the 2nd respondent to register the Sale Deed dated 06.03.2026.

2. Heard Mr.S.Stevenson, learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Additional Government Pleader, who takes notice on behalf of the respondents.

Upon hearing the learned counsel appearing for the petitioner and perusing the material records of the case, it can be seen that the impugned refusal check slip dated 06.03.2026 itself refers to documents of the year 2011. As a matter of fact, the property in question was dealt with as a Kudi Iruppu Manai Pirivu, along with rights to a pathway, including the right to obtain an electricity connection, as reflected in the schedule to Document No. 4736 of 2011. Thus, it is clear that well

before the year 2016, the property in question had already been treated as a residential plot. Therefore, the reason stated for refusing the document cannot be sustained.

4. In view thereof, the writ petition is allowed on the following conditions:- i. The impugned refusal check slip dated 06.03.2026 is set aside. ii. Within one week from the date of receipt of a web copy of the order, without waiting for the certified copy of the order, the petitioner is directed to represent the document before the respondents for registration.

iii. As and when the same is represented, the same shall be registered by the respondent, if there is no other impediment. iv. No costs. Consequently, connected miscellaneous petition is closed.
