ORDER

By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

2. This writ petition has been filed for a Mandamus directing the respondent to grant all the retirement benefits, including Pension, Gratuity, Provident fund and Earned Leave Salary entitled by the petitioner, by considering his representation dated 04.05.2022.

3. The case of the petitioner is that he was appointed as Meter Leader in the respondent Corporation on 10.01.1990 and thereafter, he was promoted as Bill Collector on 06.09.2006. After working as Bill Collector in the respondent Corporation for the period of 30 years, due to medical invalidation, he was allowed to retire from service on 31.01.2021. While he was in service, the respondent Corporation issued a charge memo dated 29.06.2015 against the petitioner and after the enquiry, the respondent Corporation, by proceedings dated 07.06.2021, passed an order of punishment imposing stoppage of increment without cumulative effect for a period of one year. Now, it is the grievance of the petitioner that though he retired from service on 31.01.2021, he was not granted any retirement benefits till date.

In this regard, he made representations dated 27.01.2021 and 04.05.2022 to the respondent Corporation. However, the same has not been considered. Therefore, https://hcservices.ecourts.gov.in/hcservices/ 1/2

4. The learned Standing Counsel appearing for the respondent Corporation submits that the representation of the petitioner would be considered in accordance with law.

5. In view of the said submission, this Court, without going into the merits of the case, directs the respondent to consider the petitioner's representation, dated 04.05.2022 and pass appropriate orders on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order. 6.With the above direction, this Writ Petition is disposed of. No costs.
