ORDER

Seeking direction to the respondents 1 and 2 to give adequate police protection to the petitioner and his family members for offering "Nerthikadan" on 10.04.2026 to the temple of "Arul Mighu Siva Sudalai Maada Swamy Temple" situated in Mettukudirupu, Anjugramam Village, Kanyakumari District, by considering the petitioner's representation dated 20.03.2026, this Writ Petition has been filed.

Considering that no adverse order is likely to be passed against the respondents 3 and 4, notice to them is dispensed with. 3.It is the case of the petitioner that since the respondents 3 and 4, who are administrating the temple in question, are preventing the petitioner to offer Nerthikadan in the said temple, he has sent a representation to the second respondent on 20.03.2026 seeking protection. However, the same has not been considered so far. Hence, this petition.

4.The learned Government Advocate (Criminal Side) submitted that necessary police protection would be provided, only after hearing the concerned parties and upon finding the petitioner's claim to be genuine. 5.Considering the facts and circumstances of the case, the second respondent is directed to issue notice to the petitioner, respondents 3 and 4, and all other interested parties, and to conduct an enquiry. Thereafter, if the petitioner's claim is found to be genuine, the respondent police shall afford necessary police protection to the petitioner on the specified date for offering Nerthikadan to the aforesaid temple, upon receipt of payment from the petitioner, in accordance with G.O. (Ms) No.139, Home (Pol-VIII) Department, dated 04.03.2019.

6.With the above directions, this Writ Petition is disposed of. It is made clear that the petitioner shall not claim any special rights of first honour, and only the right of worship as a devotee is recognized. 01.04.2026 NCC : Yes / No Index : Yes / No Rmk Note: Issue order copy on 06.04.2026 3/5
