ORDER : The Court Made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offence punishable under Section 379 I.P.C. in Crime No.140 of 2018, seek anticipatory bail.
2. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the first petitioner is having one previous case, which is similar in nature. The second petitioner is having three previous cases to his credit. Out of that, he has already suffered conviction in one case.
3.Taking note of the antecedents of the second petitioner, this Court is not inclined to grant anticipatory bail to the second petitioner. Accordingly, this Criminal Original Petition is dismissed in respect of the second petitioner. 4.The learned counsel for the petitioners undertakes that the first petitioner shall contribute a sum of Rs.5,000/- (Rupees five thousand only) to the credit of Chief Justice Relief Fund, Madurai Bench of Madras High Court, Madurai.

anticipatory bail to the first petitioner. Accordingly, the first petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Sivagiri, Tirunelveli District and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the first petitioner shall appear before the respondent police as and when required for interrogation. The first petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.The first petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed. sd/- 06/07/2018 / TRUE COPY / Sub-Assistant Registrar (C.S.)
