ORDER : The Court made the following order :- The petitioner /A4, who was arrested and remanded to judicial custody on 12.10.2024 for 1/6

the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of NDPS Act, 1985, in Crime No.481 of 2024 on the file of the respondent police, seeks bail.

The case of the prosecution is that on 12.10.2024 at about 18.30 hours, based on the secret information received by the Sub Inspector of Police, he along with police party went to under Kamarajar Bridge, at that time, the petitioner and other accused came in the auto bearing Registration No.TN 59 AF 5784, and the respondent Police searched auto and found that the petitioner and other accused persons were in possession of 24.500 kgs of Ganja. Hence, the case.

3. There is no representation on the side of the petitioner.

The learned Additional Public Prosecutor appearing for the respondent would submit that this case was registered as against the petitioner and others for the illegal transportation of 24.500 kgs of Ganja, which are commercial quantity. The petitioner has seven previous cases. He would further submit that the petitioner was in conscious possession of contraband at the time of arrest. He would further submit that the investigation is still pending and the offences are grave in nature and hence, he strongly opposed to grant bail to the petitioner.

5. Heard the learned Additional Public Prosecutor appearing for the respondent Police and perused the materials available on record.

6. Considering the rival submissions made on either side, considering the fact that the 3/6

quantity of contraband involved in this case is a commercial quantity and the petitioner was in conscious possession of contraband at the time of arrest and the petitioner has seven previous cases, out of which, one is a similar kind of offence, hence, this Court is declined to grant bail to the petitioner at this stage.

Accordingly, the Criminal Original Petition is dismissed.
