No.76575 dated 13.03.2026 are not valid and the same has to be quashed as devoid of merits and consequently direct the respondents to promote the petitioner as Statistical Officer based on the petitioner's representation dated 20.02.2026.

ORDER
This writ petition has been filed seeking a writ of certiorarified mandamus challenging the impugned proceedings dated 27.02.2026 and 13.03.2026 whereby various candidates were promoted to the post of Statistical Officer from the post of Statistical Inspector. None of the promoted candidates have been impleaded as party respondents to the writ petition. In the absence of the same, the validity of the impugned proceedings cannot be gone into, as any interference with the impugned proceedings would adversely affect the beneficiaries. 2/6

Be that as it may, the short grievance of the petitioner in the present writ petition is that the respondents while effecting promotions to the post of Statistical Officer in the respondent Department have not given effect to the orders issued by the Government in G.O.(Ms.)No.6, Welfare of Differently Abled Persons (DAP-3.2) Department, dated 21.06.2025.

The respondents have filed a detailed counter affidavit stating that the directions issued in G.O.(Ms.)No.6, Welfare of Differently Abled Persons (DAP-3.2) Department, dated 21.06.2025 have been taken into consideration while effecting impugned promotions and the roster point numbers 25 and 125 have been earmarked for blind category of candidates and the petitioner has not fallen within the zone of consideration. Therefore, his case could not be considered. Further, it is also stated in the counter affidavit that the detailed representation submitted by the petitioner after the impugned proceedings has been considered by the respondents and the reasons for not considering his case have been furnished to the petitioner through the proceedings No. 3/6
497/B2/2025/Comp.No.64839 dated 02.04.2026. A copy of the same is also placed before this Court.

In the said proceedings, the respondents have categorically stated that the petitioner's case was considered for promotion duly applying G.O.(Ms.)No.6, Welfare of Differently Abled Persons (DAP-3.2) Department, dated 21.06.2025 and in terms of para No. 7 of its Annexure, the petitioner has not come up within the zone of consideration so as to consider his case by applying the said Government Order in the turn earmarked for physically disabled persons. The said communication dated 02.04.2026 is already served on the petitioner.
5. In the light of the said proceedings and in the light of the detailed counter affidavit filed by the respondents, this Court does not see any reason to go deep into the matter. In case, if the petitioner is aggrieved by the said communication dated 02.04.2026, where reasons have been assigned, it is for the petitioner to take appropriate steps against the said communication duly in accordance with law. 4/6
6. Accordingly, this writ petition is dismissed granting liberty to the petitioner to take appropriate steps against the communication dated 02.04.2026, if so advised. No costs. Consequently, connected miscellaneous petitions are closed.
