Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.P.MANOKARAN, Advocate for the petitioner and of MR.P.KOTTAICHAMY, Government Advocate(Crl.side) on behalf of the 1st Respondent and Mr.A.MANIKANDAN, Advocate for the 2nd respondent, the Court made the following order:- 1/4
The petitioner/Defacto complainant has moved this petition to cancel the anticipatory bail granted to the 2nd respondent in Crl.O.P(MD) No.19527 of 2023, dated 02.11.2023.
2.The learned counsel for the petitioner submitted that the 2nd respondent has not complied with the condition imposed in Crl.O.P(MD) No.19527 of 2023. Hence, prays to cancel the anticipatory bail granted to the 2nd respondent. 3.The learned counsel for the 2nd respondent submitted that she is not in a position to comply with the condition imposed by this Court in Crl.O.P(MD) No.19527 of 2023. It is not intentional and she is ready to settle the issue by way of repaying a sum of Rs.1 lakh to the petitioner. 4.The learned counsel for the 1st respondent Police submitted that the 2nd respondent has filed petitions seeking for extension of time twice. Even thereafter, the 2nd respondent is not ready to settle the amount. 5.It is seen from the records that the 2nd respondent is arrayed as an 2/4
accused in Cr.No.275 of 2023 for the offence under Sections 468, 406 and 420 of IPC. The 2nd respondent has approached this Court for grant of anticipatory bail in Crl.O.P(MD) No.19527 of 2023 and this Court vide order, dated 02.11.2023 granted anticipatory bail to the 2nd respondent with a condition to deposit a sum of Rs.4,70,000/- to the credit of Crime No.275 of 2023. Thereafter, the 2nd respondent has filed a petition for modification of condition and the same was dismissed by this Court on 13.12.2023. Further, the 2nd respondent has filed petitions seeking for extension of time and this Court has also granted extension twice. However, the 2nd respondent has failed to comply with the condition imposed by this Court. 6.Since the 2nd respondent has failed to comply with the condition imposed by this Court, the anticipatory bail granted to the 2nd respondent in Crl.O.P (MD) No.19527 of 2023 is cancelled. The 1st respondent Police is directed to secure the 2nd respondent forthwith.
