Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 to 5, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 174 Cr.P.C. @ Section 306 of IPC in Crime No.20 of 2016 on the file of the respondent police and hence, seek anticipatory bail.

2. The case of the prosecution is that the petitioners quarrelled with the deceased and abused her in filthy language and attacked her and also insisted the deceased to commit suicide. Due to that, the deceased committed suicide, by hanging. On complaint, a case has been registered against the petitioners.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. He further submitted that both the deceased and the petitioners are neighbours and the deceased husband was working in abroad. The deceased was having illegal intimacy with 5th petitioner. Since there was a family dispute between the petitioners and the defacto complainant, a false complaint has been given against the petitioners. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Government Advocate (Crl. Side) submitted that the fifth petitioner was having illegal intimacy with the deceased. When the deceased refused to continue the same, the petitioners insisted her to continue her relationship. Due to which, she committed suicide and the investigation of the case is pending. 5.Considering the serious nature of allegations levelled against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.
