ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 379 I.P.C and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.58 of 2018, seeks anticipatory bail.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent. 3.The petitioner fairly stated in the petition that he was arrested on 19.05.2018 and that he was granted interim bail by the learned Judicial Magistrate No.I, Thoothukudi to enable him to take treatment for his kidney problem. Interim bail was granted subject to the condition that he himself surrender. The petitioner without surrendering in terms of the condition imposed in the interim bail order, he has now moved this Court seeking anticipatory bail. 4.On the very face of it, this Criminal Original Petition is not maintainable. When the petitioner was arrested and he was granted bail subject to the above said condition, he must be complied with the condition. The petitioner has not followed the Court process.

5.The learned Government Advocate(Crl.Side) appearing for the respondent submitted that the petitioner is having four previous cases to his credit.

6.Taking note of all these aspects, this Criminal Original Petition is dismissed as not maintainable.
