Respondents Prayer: Writ Petition - filed under Article 226 of Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned proceedings in Oo.Mu.No.16906/Ni5/1/2019 dated 17.06.2020 by returning back petitioner's family pension papers to the petitioner passed by the first respondent and quash the same and consequently direct the first respondent to receive the petitioner's family pension papers and forward the same to the second respondent for the petitioner's family pension.

ORDER

The learned counsel appearing for the petitioner submits that in the impugned order dated 17.06.2020 the request of the petitioner, for getting family pension for the death of his father, was returned on the ground that in order to prove that she is a destitute woman after getting divorce, the petitioner since has produced only the customary divorce obtained from the Panchayat but not the divorce decree obtained from the competent Court of law. https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.9821 of 2020 Therefore, eliciting the said position, the learned counsel after some arguments, wants to withdraw this writ petition with liberty if any need arises in future.

2. With the said liberty, the petitioner is permitted to withdraw the writ petition and accordingly dismissed as withdrawn. No costs.
