Sriram ...3rd Respondent/De-facto complainant PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the First Additional Sessions (Special Court for SC/ST Act cases, PCR), Trichy, to consider the Bail application of the petitioners in Crime No.28 of 2021 on the same date of surrender and dispose the same on its merits in accordance with law. For Petitioner : Mr.R.Maheswaran For R1 and R2 : Mr.R.M.Anbunidhi Additional Public Prosecutor O R D E R This petition has been filed seeking a direction to the First Additional Sessions (Special Court for SC/ST Act cases, PCR), Trichy, to consider the Bail application of the petitioners in Crime No.28 of 2021 on the same date of surrender and dispose the same on its merits in accordance with law.

2. It is brought to the notice of this Court that on earlier occasion, the petitioners moved a similar petition in Crl.O.P.(MD) No.2066 of 2021 that was allowed on 11.02.2021 and a direction was given to the petitioners to surrender before the Court concerned within a period of 15 days from the date of receipt of a copy of the order and later, they filed a petition in Crl.M.P.(MD)No.2170 of 2021 seeking further time of 15 days to file a bail application before the concerned Court and the same was allowed on 15.03.2021, granting 15 days' time and the extension period expired on 30.03.2021.

3. The learned counsel for the petitioner submits that due to the pandemic, the Subordinate Courts were closed and hence, the petitioners are not in a position to comply with the order. https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.8691 of 2021 Therefore, the petitioners have filed the present petition.

It is seen that the petitioners had already filed a petition in Crl.O.P.(MD)No.2066 of 2021 seeking the very same relief and the same was allowed by this Court, vide order dated 11.02.2021 and since the petitioners were not able to surrender before the Court, they filed a petition seeking extension of time in Crl.M.P. (MD)No.2170 of 2021, that was also granted by this Court, vide order dated 15.03.2021. Now, once again, the petitioners have come to this Court by way of filing the present petition repeatedly seeking the very same relief. Therefore, the present petition cannot be entertained. Now, the Subordinate Courts are functioning now. The petitioners are at liberty to file a petition seeking extension of time.

5. With the above liberty, this Criminal Original Petition is dismissed.
