O R D E R

This Criminal Original Petition has been filed seeking a direction to modify the condition to sign before the trial court as and when required instead of signing before the trial court daily in Crl.M.P.No.6 of 2024 in C.C.No.181 of 2017 on 19.11.2024 on the file of Communal clash Cases Court, Madurai.

2.The learned Counsel for the petitioner would submit that the learned Sessions Judge, Communal Clash Cases, Madurai, passed order on 19.11.2024. At the time of cancelling the non bailable warrant, the trial Court imposed condition to appear before the Court on all working days at 10.00 A.M until further orders. The petitioner is complying the condition from 19.11.2024 without fail. Thereafter, the petitioner approached the same Court for relaxation of condition and the same was dismissed. Hence this petition.

3.The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that the petitioner has not appeared before the trial Court regularly, thereby, the trial Court issued non 2/5

bailable warrant and thereafter, the petitioner approached the trial Court for cancelling the non bailable warrant and the same was allowed through order, dated 19.11.2024 on condition to report before the trial Court on all working days at 10.00 A.M until further orders. The petitioner is complying the condition without fail. However, the trial is pending. Therefore, he opposed to relax the condition. 4.Considering the rival submission made on either side and the nature of offences and the stage of trial and also taking note of the fact that the petitioner is complying with the condition till date, the condition imposed on the petitioner is relaxed and the petitioner shall appear before the trial Court as and when required by the trial Court. 5.With the above direction, this criminal original petition is disposed of.
