: Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents herein to disburse the General Provident Fund, Commutation of Pension, Death -cum- Retirement Gratuity, Encashment of Leave, Special Provident Fund and other terminal benefits with 18% interest from 18.05.2009 to the actual date of payment which is due to the petitioner's husband. ORDER
The petitioner has come forward with the present Writ Petition seeking for the issuance of a Writ of Mandamus, directing the respondents herein to disburse the General Provident Fund, Commutation of Pension, Death -cum- Retirement Gratuity, Encashment of Leave, Special Provident Fund and other terminal benefits with 18% interest from 18.05.2009 to the actual date of payment which is due to the petitioner's husband. https://hcservices.ecourts.gov.in/hcservices/
2. Mrs.Srimathy, learned Special Government Pleader, takes notice on behalf of the respondents 1 to 3 and Mr.P.Gunasekaran, learned Standing Counsel, takes notice on behalf of the fourth respondent.
3. By consent, the Writ Petition is taken up for final disposal at the stage of admission itself.
4. The petitioner has sent a representation dated 27.10.2017 to the fourth respondent seeking terminal benefits of her husband and since the same has not been considered so far, the petitioner is before this Court with the present Writ Petition for the reliefs as stated above.
5. Considering the facts and circumstances of the case, without going into the merits of the case, a direction is given to the fourth respondent to consider and dispose of the representation made by the petitioner dated 27.10.2017 on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. The petitioner is also directed to send a copy of the representation dated 27.10.2017 along with a copy of this order to the fourth respondent forthwith.
6. The Writ Petition is disposed of with the above direction. No costs.
