PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the 1st respondent to consider the representation dated 07.07.2020 to effect mutation, make changes in the revenue records in respect of Survey No.233/1 and other survey numbers of 24 properties in total situated at Allinagaram Village Theni District, based on the preliminary decree of the Sub Court, Theni Theni District dated 17.10.2016, in I.A.No.572/2014 in O.S.No.216/2013 within the time stipulated by this Court.

ORDER

This Writ Petition is filed to direct the 1st respondent to consider the representation dated 07.07.2020 for mutation and for making changes in the revenue records in respect of the property in S.No.233/1 and other survey numbers of 24 properties in total situated at Allinagaram Village Theni District, based on the preliminary decree passed in I.A.No.572/2014 in O.S.No.216/2013 on the file of the Sub Court, Theni, Theni District dated 17.10.2016. 2.When the matter is taken up for hearing today, the learned Additional Government Pleader appearing for the respondents would submit that a similar relief sought for by the petitioner's father has already been rejected by the 1st respondent, by order dated 20.07.2020 and the same has also been communicated to the petitioner's father. W.P.(MD)No.10819 of 2020 Government Pleader has produced a copy of the proceedings of the 1st respondent in Na.Ka.No.111/2019/A3 on 20.07.2020. 3.At this juncture, the petitioner, who appeared party-inperson, sought permission of this Court to withdraw this writ petition with liberty to him to challenge the aforesaid rejecting order.

4.Recording the submission made by the learned Additional Government Pleader, this Writ Petition is dismissed as withdrawn with such liberty. No costs.
