Prayer: Writ Petition has been filed under Articles 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents to grant necessary permission and provide adequate police protection for conducting the following events, the Pongal Festival, on 21/05/2023 at 09.00 am, Mulaipari function, on 21/05/2023 at 03.00 P.M and Vadamadu Manjuvirattu, on 22/05/2023 at 08.00 am, Veerapandiya Kattapommam Drama, on 22/05/2023 at 10.00 pm, Gramathu Ganangal Shows on 24/05/2023 at about 10.00 pm, and Village Cultural Program on 25/05/2023 scheduled to be held from 07.00 pm to 10.00 pm, as part of Arulmighu Shri Kaliyamman Temple Pongal festival at Ammanpatti, Thiruchuli Taluk, Virudhunagar District, by considering the petitioner's representation, dated 06/04/2023 and pass such further or other orders. O R D E R
This Writ Petition has been filed seeking for direction to the official respondents to provide adequate police protection for conducting the above temple festival events, by considering the petitioner's representation, dated 06/04/2023.
2.Heard both sides.
3.When the matter is taken up for hearing, the learned counsel appearing for the newly impleaded 7th respondent would submit that every year, the above said temple festival is conducted by villagers with the help of the Revenue Officials; Now for the first time, the petitioner is going to conduct the above said festival on their own. According to him, there is two groups and if the petitioner is permitted to conduct the above said events, there is every likelihood of creating law and order problem.
4.The learned Additional Public Prosecutor would submit that because of the above said issue, peace committee meeting was proposed to be held in the month of March' 2023 itself and due to the pendency of this writ petition, no notice was also issued to the parties for appearance.
5.It is clarified that pendency of the writ petition need not be taken as bar for convening of the above said meeting. Only the peace committee meeting will resolve
the issue. So the Tahsildar, Thiruchuli Taluk, Virudhungar District, the 5th respondent herein is directed to convene the peace committee meeting, on 05/05/2023. Depending upon the resolution to be taken in the peace committee meeting, further action may be taken the parties and as well as the authorities.
6.With the above said direction, this writ petition is disposed of. No costs.
