Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, apprehending arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 341 and 307 of IPC and Section 4 of TNPPDL Act and altered into under Sections 147, 148, 341, 307, 120(b) of IPC and Section 4 of Tamilnadu Public Proper (Prevention of Damage and Loss) Act, 1992, in Crime No.297 of 2018, seeks anticipatory bail. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent. 3.

The Political Leader by name Thiru Velmurugan was arrested. Therefore, to protest against the same a lorry containing liquor bottles belonging to TASMAC was set fire on 01.06.2018 in Dindigul - Trichy Main Road. In this regard, one Periyasamy and others were arrested. Thiru.Periyasamy had given a confession statement. According to the confession statement, the petitioner herein had instructed and directed the first accused, who is District Office Bearer of Tamizhaga Vazhvurimai Party, to indulge in the act in question.

4.Since public property has been damaged, this Court will have to take a serious view. The confession of the main accused directly implicates the petitioner herein. The Government Advocate (Crl. Side) has also pointed out that the petitioner is having as many as 13 previous cases. Of course, it appears to be political in nature, but, act of violence cannot be condoned. They have to be dealt with iron hand. In these circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
