PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to pay Arrear Salary for 56 months with 8 percent interest for the service rendered by the petitioner as a librarian in the 4th respondent library and all monetary benefits to the petitioner by considering the petitioner's representations dated 17.03.2023. The petitioner was engaged as honorary librarian on 01.06.2010, in the Library maintained by Kookudi Panchayat Office, Ramanathapuram and he was paid with a sum of Rs.750/- per month as honorarium. The petitioner with a grievance that he has not been paid with honorarium from the year 2013, has filed this writ petition in the year 2023, seeking a Mandamus to the respondents to pay arrears of salary for 56 months together with 8% interest for the honorary service rendered by the petitioner, by considering his representation dated 17.03.2013.

2.The respondents have filed a counter statement that the petitioner's service was terminated with effect from 13.11.2013 and thereafter one Pandiammal was appointed as a honorary librarian in the place of the petitioner. According to the learned Special Government Pleader there is no arrears of salary as claimed by the petitioner. The learned Special Government Pleader has also produced a copy of the resolution of Kookudi Panchayat, Tiruvadanai Taluk, Ramanathapuram dated 13.11.2013, in and by which, this petitioner has been relieved from the post of the honorary librarian and another person, namely, one Pandiammal has been inducted in the place of the petitioner. 3.This Court considered the rival submissions made and also perused the materials placed on record.
4.This petitioner claims that he has been engaged as honorary librarian in the Library maintained by the fourth respondent Panchayat in the year 2010, however he has not been 3/6
paid with honorarium from the year 2013. On the other hand, the respondents claim that one Pandiammal has been appointed as a honorary librarian on 13.11.2013 in the place of the petitioner and in order to substantiate this contention, the learned Special Government Pleader has produced a copy of the resolution passed by the Kookudi Panchayat, Tiruvadanai Taluk, Ramanathapuram, dated 13.11.2013.
5.In view of the above, this writ petition is closed. The learned Special Government Pleader is directed to furnish a copy of the resolution, dated 13.11.2013 to the petitioner. No costs. 03.12.2025 NCC: Yes/No Index:Yes/No vrn 4/6
