For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Cr.No.72 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(1)(a), 4(1-A), 4(1)(g) TNP Act in Crime No.72 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that on 31.05.2021, when the police party was engaged in preventing of offences relating to prohibition Act, they got an information that the accused are preparing illicit liquor on the west of Seevaneri kanmai. When they reached, six persons escaped form the scene and remaining five persons were apprehended and they revealed their names as Nandu @ Sundarraj, Sonaimuthu, Karuppasamy, Mahendran, Ramanathan and they were in possession of 15 liters of wash to prepare illicit arrack. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Government Advocate(Crl.side) appearing for the respondent police opposed this petition on the ground that investigation is pending and the petitioner is having five previous cases, in which, one case was registered under Tamil Nadu Prohibition Act.

5.Taking note of the fact that the petitioner is having five previous cases and one case is similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner.
