O R D E R

The present writ petition has been filed for a Writ of Certiorarified Mandamus to quash the impugned orders passed by the second respondent vide proceedings in Ref.No.13775/E5/1/2025 dated 30.01.2026 and the rejection order in Ref No.13775/E5/1/2025 dated 03.03.2026 and consequently, direct the second respondent to include the petitioner's name in the statistician panel for the year 2025-26.

2. The learned counsel for the petitioner submitted that the petitioner has been working as Junior Assistant in Tirunelveli Medical College, Tirunelveli from 2020. On 26.02.2025, the second respondent issued a circular vide Ref.No.13775/E5/1/2025 dated 26.02.2025 and called for the willing candidates' particulars for the preparation of the panel for the post of Statistician for the year 2025-26. In the above 2/6

circular, one of the educational qualifications for the post of Statistician is an Undergraduate Degree in Mathematics with Statistics as an Ancillary Subject. Since the petitioner has also possessed such qualification, the petitioner has applied for the same. However, the same was rejected by the second respondent vide proceedings in Ref.No. 13775/E5/1/2025 dated 30.01.2026 by stating that the petitioner is not eligible to such post, against which, on 12.02.2026, an appeal was preferred by the petitioner and the same was also rejected by the second respondent vide Ref.No.13775/E5/1/2025 dated 03.03.2026. Aggrieved over the said orders, this writ petition has been preferred.

3. The learned Additional Government Pleader for the respondents stated that the petitioner has passed only Fuzzy Mathematics and Statistics and hence, she is not eligible.

4. The learned counsel for the petitioner, however, pointed out that as far as Undergraduate is concerned, the petitioner has completed B.Sc. (Mathematics) with Ancillary Subjects of Computer Science and Statistics, for which the petitioner has relied on Course Certificate issued 3/6

by the concerned college. On the other hand, the learned Additional Government Pleader for the respondents submitted that the petitioner has completed only Fuzzy mathematics.

5. It is seen that the petitioner has completed Fuzzy Mathematics and Statistics in P.G. only and not in U.G. In undergraduate, the petitioner has completed Mathematics with Statistics as ancillary subject. It is evident from the courses offered by the Manonmaniam Sundaranar University, where the codes are stated as EMAC1- Fundamentals of Statistics, EMAC2 - Probability Theory, EMAC3 - Sampling Theory and EMAC4 - Applied Statistics under the head of Statistics. Hence, the petitioner has completed Fundamentals of Statistics, Probability Theory, Sampling Theory and Applied Statistics, in Undergraduate along with Mathematics as main subject. Therefore, the reasons cited by the respondents are incorrect and total non application of mind. Hence, the impugned order is set aside only in respect of the petitioner.

6. The respondents are directed to reconsider the petitioner's claim based on the petitioner's certificates. The said exercise shall be completed 4/6

within a period of four (4) weeks from the date of receipt of a copy of this order.

It is made clear that the present order is applicable only to the petitioner alone.

7. With these directions, this Writ Petition is allowed. No costs. W.M.P.(MD) No.7087 of 2026 is ordered. Consequently, connected miscellaneous petition is closed.
