O R D E R
The petitioner is before this Court seeking for a direction to the respondent to rectify the date of birth of the petitioner in passport S9940591 as 30.06.1994 instead of 30.08.1994 and reissue passport. In this regard, the petitioner submitted a representation dated 24.02.2026.
2. Ms.S.Mahalakshmi, learned Central Government Standing Counsel for the respondent submitted that the date of birth mentioned in the passport is as per the date of birth mentioned in the birth certificate and unless the birth certificate is rectified, the petitioner's request cannot be considered.
3. The Ministry of Home Affairs, Government of India, has issued guidelines/circulars prescribing the documents that may be produced for issuance or correction of passport particulars. As per the said guidelines, documents such as Aadhaar Card, Elector's Photo Identity Card (EPIC), Service Identity Card issued by the State or Central Government, Birth Certificate issued under the Registration of Births and Deaths Act, and 2/6
other specified documents can be relied upon.
4. In the present case, the petitioner has produced copies of the Aadhaar Card and PAN Card, which indicate the petitioner's date of birth as 30.06.1994. The said documents are recognized identity documents and form part of the acceptable proof for establishing date of birth.
5. In view of the above, this Court is of the opinion that the respondent is bound to consider the petitioner's request for correction of date of birth on the basis of the documents produced, subject to verification in accordance with law.
6. Learned Standing counsel for the respondent submitted that the application is of the year 2024 and the said application has been closed and therefore, the petitioner may make an application afresh.
7. Accordingly, this Writ Petition is disposed of, reserving liberty to the petitioner to make an application afresh for rectifying the date of birth as 30.06.1994 instead of 30.8.1994 and if such an application is 3/6
filed, the respondent shall consider the same in light of the observation made above.
8. The respondent shall dispose of the application to be submitted by the petitioner within a period of four(4) weeks from the date on which the application be submitted by the petitioner. 9.There shall be no orders as to Costs.
