Writ Petitions are filed under article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents 3 and 4 to consider the objection of the petitioner dated 31.07.2025 and not to register

the property in respect of the property in Survey No.388/1B1, at Korampallam Village, Thoothukudi Taluk, Thoothukudi District. For Petitioner :Mr.S.Ramsundarvijayraj For R1 to R4 :Mr.F.Deepak Special Government Pleader

ORDER

This writ petition is filed for a mandamus directing the respondents to consider the objection of the petitioner dated 31.01.2025 and not to register the property in Survey No.388/1B1 at Korampallam Village, Thoothukudi Taluk, Thoothukudi District.

2.This writ petition is disposed of at the admission stage and this Court is not expressing any opinion with reference to the merits of the allegations that is made by the petitioner.

3.The case of the petitioner is that the petitioner is only the owner of the property and since there was joint patta, the other joint Patadars have wrongfully dealt with the petitioner's property also. The private respondents without any right, title or interest whatsoever are dealing with the petitioner's land. Therefore, the petitioner has submitted the above objection. When Patta was also changed, the petitioner is also taking up the issue with the Revenue, the matters are pending in between the parties no document further can be registered.

4.Upon considering the grievance of the petitioner, since already document has been registered, the appropriate relief for the petitioner is to approach the Civil Court to get declaration with reference to the ownership of the petitioner and also with reference to the validity of the said document, as the case may be. As far as the objections are concerned, at best the Sub Registrar can consider the objection, when any document is presented for registration. If any party is going to present any document with reference to survey No.388/1B1, at that instance notice can be issued and an enquiry can be conducted with reference to the objections at the time of carrying out the registration .

5.In view thereof, this writ petition is disposed on the following terms:

(i)If only any further document is presented by any other party with reference to survey No.388/1B1 at Korampallam Village, Thoothukudi Taluk, Thoothukudi District, the 4th respondent shall consider the objections raised by the petitioner in the manner known to law, by issuing due notice to the all the parties concerned.

(ii)As far as the relief not even to restrain the respondents from presenting any document, it is for the petitioner to approach the competent civil Court for an appropriate relief and as and when the said suit is filed,

the same shall be dealt with as expeditiously as possible. (iii)No costs. Consequently, connected miscellaneous petition is closed.
