Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Certiorarified Mandamus to call for the records relating the impugned order passed by the second respondent vide his proceedings in Na.Ka.No.8012/2015/C.V-2 dated 20.02.2015 and quash the same as illegal and consequently to direct the respondent to reinstate the petitioner into service with all other monetary benefits. ORDER

Mr.M.Muniyasamy, learned Standing Counsel, takes notice for the respondents and by consent of both the parties, the main Writ Petition itself is taken up for final disposal at the stage of admission.

2. Heard the learned Counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents.

3. The petitioner is aggrieved against the order of suspension dated 20.02.2015, which came to be passed, on making certain allegations against the petitioner. At this stage, this Court is not inclined to go into the merits of the allegations made against the petitioner to give a finding as to whether those allegations are true or not, as it is for the Disciplinary Authority to hold the enquiry and pass final orders, on merits and in accordance with law.

Therefore, this Writ Petition is disposed of with a direction to the Disciplinary Authority to conduct the disciplinary Proceedings against the petitioner and pass final orders, on merits in accordance with law, within a period of three months from the date of receipt of a copy of this order. It is needless to say that during the period of suspension, the petitioner is entitled to get subsistence allowance. No Costs. Consequently, connected Miscellaneous Petition is closed.
