ORDER

This writ petition is filed to issue a Writ of MANDAMUS directing the Respondents to issue a patta in the Petitioner's favour in respect of the property comprised in Survey Nos. 397/4, 397/5, 397/8, 397/14, 397/15, 397/16, 397/17, 397/18, and 397/19 particularly plot No. 135 to an extent of 0.01.0 Ares situated at Ponnamaravathi East, Ponnamaravathi Taluk, Pudukkottai District in the light of order passed by the 1st Respondent in Na.Ka.No.A2/938/2016 dated 21.01.2019 within time frame as fixed by this Court.

The contention of the petitioner is that property to an extent of 0.01.0 ares in Plot No. 135 was acquired under the Adi Dravidar Welfare Scheme, and the same was divided into housing plots and assigned to various eligible persons in accordance with the rules and regulations. While so, certain individuals filed a suit in O.S. No. 44 of 2025 on the file of the Principal District Munsif-cum-Judicial Magistrate Court, Thirumayam, Pudukkottai District, seeking a declaration to declare the assignment order dated 20.04.2022 as null and void, and for an injunction restraining the official respondents from issuing patta in favour of the beneficiaries. After a full-fledged trial, the suit was dismissed. Aggrieved by the same, an appeal was preferred in A.S. No. 34 2/6

of 2012 on the file of the Subordinate Court, Pudukkottai, which was also dismissed. Another individual filed a suit in O.S. No. 262 of 2023 on the file of the District Munsif-cum-Judicial Magistrate Court, Ponnamaravathi, in which the petitioner was impleaded as the fourth defendant, and the same was dismissed for default.

3. In such circumstances, the petitioner is seeking issuance of patta. The petitioner has put up construction and is paying electricity charges and other taxes. Therefore, the official respondents submitted that patta had already been issued vide proceedings dated 21.01.2018, and the petitioner's name appears at Serial No. 3.

4. Considering the rival submissions, this Court directs the second respondent to consider the petitioner's claim in the light of the order dated 21.01.2018 and pass appropriate orders within a period of 12 weeks from the date of receipt of a copy of this order.

5. With these observations, this writ petition is disposed of. No costs.
