PRAYER :-Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, directing the 1st Respondents to survey the property in Survey No. 511/4A1B of Kovalam village, Kanniyakumari district and thereafter to make entry of subdivision in the FMB of Survey no. 511/4A in respect of the pathway within a specific period.

O R D E R
This writ petition has been filed seeking a direction to the 1st respondent to survey the property in Survey No. 511/4A1B of Kovalam village, Kanniyakumari district and thereafter to make entry of subdivision in the FMB of Survey no. 511/4A in respect of the pathway within a specific period.
2. Heard the learned counsel for the petitioner, the learned Government Advocate leader appearing for the official respondents.
3. The petitioner submitted a representation to the official respondents for survey and subdivision of the property in question. Since no action has been taken on the said representation, the petitioner is before this Court with this writ petition.
4. Learned Government Advocate, appearing for the official respondents, submits that the Revenue Divisional Officer is the competent authority to consider the representation of the petitioner. However, the petitioner has not arrayed the Revenue Divisional Officer as a party to the writ petition. If a representation is addressed to the 2/5
Revenue Divisional Officer, the same would be considered within a time stipulated by this Court.
5. In view of the said submission, the Revenue Divisional Officer, Agastheeswaram Taluk, Kanyakumari District is suo-motu impleaded as respondent No.4. Registry to carry out necessary amendment before issuing copy of the order.

In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the Revenue Divisional Officer, Agastheeswaram Taluk, to consider the petitioner's representation dated 29.02.2024, conduct enquiry and hear all the parties and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. Needless to say, if any rival claims, the same shall be subject to the jurisdiction of the civil Court. There shall be no order as to costs.
