ORDER

This petition is filed by the petitioner to direct the learned Judicial Magistrate, Santhankulam, to expedite the trial and dispose the case in STC.No.572 of 2022 on its file, within a stipulated time fixed by this Court.

2. According to the petitioner, he is the first accused in this case. FIR was registered in the year 2021 and cognizance was taken in the year 2022. But, trial has not been commenced so far. Therefore, filed this petition.

The learned Additional Public Prosecutor (crl.side) appearing for the respondent-police, on instructions, submits that based on the complaint given by the defacto complainant/second respondent, they registered an FIR in Crime No.346 of 2021 for the offences under Sections 147, 447, 294(b), 427 and 506(1) of IPC. Thereafter, they filed a final report and now, the case is pending before the learned Judicial Magistrate, Sathankulam, for appearance of accused. He further submits that they are ready to co-operate for speedy disposal of the case by producing witnesses without any delay. 2/5

4. Considering the prayer sought for in this petition, this Court, without issuing notice to the second respondent, is inclined to pass order in this petition.

5. According to the petitioner, occurrence took place in the year 2021 and still no trial was commenced. Therefore, he filed this petition. The first respondent assured that they will co-operate for speedy disposal of the case by producing the witnesses as directed by the trial Court. Therefore, considering the long pendency of the case, this Court directs the learned Judicial Magistrate, Sathankulam, to complete the trial proceedings in STC.No.572 of 2022 within six months from the date of receipt of a copy of this order.

6. With the above direction, this Criminal Original Petition is disposed of.
