RESPONDENT/ RESPONDENT IN BOTH THE PETITIONS CRL MP(MD) No.5556 of 2018 IN CRL OP(MD) No.4798 of 2018: Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to condone the absence on 02.06.2018 for condition that the Petitioner stay at Tirunelveli, imposed by this Hon'ble Court in Crl.OP(MD) No.4798 of 2018 dated 05.04.2018.

Prayer in CRL MP(MD). 5557/ 2018 IN CRL OP(MD) No.4798 of 2018: To relax the condition imposed on the petitioner in Crl.OP(MD) No.4798 of 2018 dated 05.04.2018 on the file of this Hon'ble Court. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.R.JEGADEESWARAN, Advocate for the petitioner in both the petitions and of Mrs.M.ANANTHA DEVI, Government Advocate(crl.Side) on behalf of the Respondent in both the petitions, the court made the following order:- This Criminal Miscellaneous Petition has been filed seeking to condone the absence of the petitioner on 02.06.2018 in complying with the condition that the petitioner shall stay at Tirunelveli, imposed by this Court in Crl.O.P.(MD).No.4798 of 2018 dated 05.04.2018.

2.The petitioner was granted bail by this Court on 05.04.2018 and a condition was imposed that the petitioner should stay at Tirunelveli. It appears that the petitioner's wife was admitted in Tuticorin Government Hospital. It is also seen that the petitioner was implicated in two other cases. was absent on 02.06.2018 and that he had not complied with the condition.

3.Taking note of the facts and circumstances set out in this petition, this Court is of the view that the breach committed by the petitioner can be condoned and the earlier condition to stay at Tirunelveli is also relaxed fully.
