Respondent PRAYER: Criminal Original Petitions are filed under section 439(1)(b) of CR.P.C praying to modify the conditional order imposed in Crl.M.P.No.1685 of 2016 dated 12.05.2015 on the file of the Sessions Court, Kanyakumari District at Nagercoil, to stay at Thirunelveli and appear and sign before the Inspector of Police, Thirunelveli Town Police Station. ORDER

This Criminal Original Petition seeking modification of the order imposed in Crl.M.P.No.1685 of 2016, dated 12.05.2015, on the file of the Sessions Court, Kanyakumari District at Nagercoil, to stay at Thirunelveli and appear and sign before the Inspector of Police, Thirunelveli Town Police Station.

2. The learned counsel appearing for the petitioner submitted that the petitioner is woman aged about 40 years and having three children. He further submitted that it is very difficult for the petitioner to comply the condition imposed by the Sessions Court, Kanyakumari District at Nagercoil, to stay at Thirunelveli and appear and sign before the Inspector of Police, Thirunelveli Town Police Station daily at 10.00 am until further orders.

3. The learned Government Advocate (Crl.side) submitted that the petitioner has complied the condition only for three days and prayed for dismissal of this petition.

4. Considering the facts and circumstances, the condition imposed by the Sessions Court, Kanyakumari District at Nagercoil is modified to the effect that the petitioner shall appear before the respondent Police daily at 10.00 am until further orders. The other conditions remains unaltered. 5.With the above direction, the Criminal Original Petition is disposed of.
