PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, directing the respondents to secure the body or person of the detenue namely, Shreemathi, D/o.Rajmohan, aged about 17 years and hand over her custody of the detenu to the petitioner. O R D E R
[Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] This Habeas Corpus Petition is filed to direct the respondents to produce the body or person of a detenue namely, Shreemathi, D/o.Rajmohan, aged about 17 years before this Court.
2. The case of the petitioner is that her daughter aged about 17 years born on 01.11.2007 was found missing on and from 25.03.2025 and did not returned to home. On information, the petitioner came to know that she was abducted by one Rajagopal @ Ramki by misleading her. The Page No.2 of 6
petitioner has given a complaint before the third respondent police and that no action was taken by the third respondent despite the registration of the case in Crime No.77 of 2025 for "girl missing", hence the present Habeas Corpus Petition has been filed by the petitioner/mother.
3. The learned Additional Public Prosecutor submitted that the based on the complaint given by the petitioner, a case in Crime No.77 of 2025 was registered by the third respondent police for "girl missing". During the course of investigation, the victim and the abductor Rajagopal @ Ramki were secured at Vedasanthur.
4. He further submitted that the case has now been transferred to the file of All Women Police Station, Vadipatty and steps are being taken to alter the offence under POCSO Act and the third respondent has produced the alleged missing girl before this Court today.
5. We enquired the alleged detenue/missing minor girl. The minor girl submitted that the said Rajagopal @ Ramki is known to her and that by misleading and he putting her under fear and undue influence, Page No.3 of 6
the said Rajagopal @ Ramki has taken her to Vedasanthur and while they were in Vedasanthur, the police have secured her. She expressed her willingness to go along with her mother. The petitioner / mother is also present before this Court.
6. Recording the said submissions, this Habeas Corpus Petition stands closed.
