Pleader for R1 to R3 COMMON ORDER W.P.(MD)No.9807 of 2022 has been filed seeking issuance of a Writ of Mandamus directing the first respondent to consider the petitioner's representation dated 02.05.2022, submitted along with other ward members, and to pass appropriate orders for conducting an enquiry by the second respondent into the alleged misappropriation of Panchayat funds, under the caption of fraud and production of false and fabricated certificates, without undertaking any works by the Panchayat, namely, Serntha Mangalam Majara Panchayat.

W.P.(MD)No.22812 of 2025 has been filed seeking issuance of a Writ of Mandamus directing the first respondent, to consider the petitioner's representations dated 02.05.2025, 14.06.2025 and 23.06.2025 and to pass appropriate orders thereon on merits and in accordance with law, within a time frame to be fixed by this Court.

3. Heard the learned counsel appearing on either side and perused the records.

According to the petitioner, he, along with other villagers, raised complaints before the first respondent seeking an enquiry by the second respondent with respect to certain irregularities and misappropriation of Panchayat funds under the caption of fraud and production of false and fabricated certificates, without undertaking any works by the Panchayat, namely, Serntha Mangalam Majara Panchayat. As no action was taken on the said complaints, the present writ petitions have been filed.

5. The learned counsel for the petitioner submits that it would suffice if the petitioner's representations dated 02.05.2025, 14.06.2025 and 23.06.2025 are considered.

6. The learned Additional Government Pleader submits that the petitioner's representations will be considered in accordance with law.

7. In view of the above, without expressing any opinion on the merits of the matter, the third respondent, namely, the Block Development Officer, Melaneethinallur Panchayat Union, Tenkasi District, is directed to consider the petitioner's representations dated 02.05.2025, 14.06.2025 and 4/6

23.06.2025 and pass final orders on their own merits, within a period of two months from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioner, the private respondent, and other interested parties, if any.

8. With the above directions, these writ petitions are disposed of. No costs.
