ORDER : The Court Made the following order :- The petitioners are arrayed as accused Nos.1 & 2, who were arrested and remanded to judicial custody on 07.04.2016 for the alleged offences punishable under Sections 302 IPC @ 147, 148, 449, 120(b), 302 of IPC r/w 34 of IPC, in Crime No.287 of 2016, on the file of the respondent police and hence, seek bail. 2.The case of the prosecution is that the son of the defacto complainant and sister of the second petitioner one Gajapriya fell in love with each other. Both belonged to different community. The son of the defacto complainant married Gajapriya without permission of the parents of the said Gajapriya. Thereafter, the second petitioner filed Habeas Corpus Petition before this Court.
The said Gajapriya was produced before this Court and at that time, she stated that she is willing to go with her parents. Subsequently, on 26.03.2016, the son of the defacto complainant was found dead. Two days before the date of occurrence, the petitioners came to the defacto complainant's house and threatened the defacto complainant and his son with dire consequences.
3.The case of the petitioners is that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. The first petitioner is uncle of said Gajapriya and the https://hcservices.ecourts.gov.in/hcservices/
second petitioner is her brother. The first petitioner's name is not found in the FIR and the second petitioner is B.E., degree holder and he has been falsely implicated due to the objection raised for their marriage.
4.The learned Government Advocate(Crl.side) submitted that totally there are 9 accused in this case. The petitioners are A1 & A2. The deceased married the sister of the second petitioner. Both belonged to different community. The petitioners went to the deceased house and threatened with dire consequences and subsequently, they kidnapped the deceased and murdered. Investigation is pending.
