O R D E R

The petitioner filed the present writ petition seeking issuance of writ of Mandamus to direct the respondents 1 and 2 to disburse the proportionate compensation for the petitioner's rightful extent of 15.043 cents out of the total acquired 17.54 cents in survey No.179/2, Alangulam Village, Alangulam Taluk, Tenkasai District, from the deposited amount of compensation in pursuant to the award No.138/2023 dated 30.06.2023 for a sum of Rs.70,14,410/-, which is lying on deposit before the Principal District Court, Tenkasi, along with accrued interest.

2. The learned Special Government Pleader for the respondents 1 and 2 submits that the compensation amount has been deposited before the Principal District Court, Tenkasi and the petitioner ought to move the Principal Court, Tenkasi for withdrawal of the amount.

3. I find force in the submission made by the learned Special Government Pleader. The petitioner ought to approach the Court where the amount has been deposited.

4. In fine, the writ petition is dismissed with liberty to the petitioner to move the competent civil Court seeking the withdrawal of the compensation amount. No costs.
