ORDER

This Writ Petition has been filed for the issue of a Writ of Mandamus, directing the respondent to consider the representation made by the petitioner on 01.02.2021, wherein the petitioner has sought for correction in the residential address that is found in the death certificate that was issued by the respondent on 20.06.2016.

The case of the petitioner is that, her father died on 13.06.1992 and since, no application was made for the death certificate, an appropriate petition was filed before the District Munsif cum Judicial Magistrate Court, Natham under the Birth and Death Act, 1969 in Crl.M.P.No.541 of 2016. The learned Magistrate, on considering the facts and circumstances of the case and the materials placed before the Court, passed an order on 22.03.2016, directing the respondent to issue a death certificate by recording the death of the father of the petitioner on 13.06.1992. Accordingly, a death certificate was also issued by the respondent.

3. The grievance of the petitioner is that a wrong address has been mentioned in the death certificate and hence, a representation was made to the respondent on 01.02.2021, seeking for correction of the address that is mentioned in the death certificate. W.P.(MD).No.10568 of 2021 same was not considered, the present Writ Petition has been filed before this Court seeking for appropriate directions.

4. Heard Mr.B.Vinothkumar, learned counsel appearing for the petitioner and Mr.M.Lingadurai, learned Government Advocate appearing for the respondent.

5. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the respondent to consider the representation made by the petitioner on 01.02.2021 and deal with the same on its own merits and take necessary decision within a period of four weeks from the date of receipt of a copy of this order.

6. This Writ Petition is disposed of with the above direction. No costs.
