ORDER : The Court Made the following order :- The petitioner is arrayed as sole accused, who was arrested and remanded to judicial custody on 18.01.2016 for the alleged offences punishable under Sections 341, 294(b), 307 and 506(ii) of IPC, in Crime No.37 of 2016, on the file of the respondent police and hence, seeks bail.

2.The case of the prosecution is that the petitioner waylaid the defacto complainant and attacked him and abused him with filthy language. On complaint, case has been registered for the above said offences.

3.The case of the petitioner is that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. The petitioner was arrested on 18.01.2016 and the petitioner filed bail application before the Sessions Court, Kanyakumari Division at Nagercoil in Crl.M.P.No.283 of 2016 and the same was dismissed on 01.02.2016 on the ground that the petitioner was detained under Act 14 of 1982. Subsequently, the petitioner filed Crl.O.P(MD)No.2403 of 2016 on 08.02.2016 before this Court and the same was dismissed by this Court on 06.04.2016 on the ground that while pending bail application before this Court, suppressing the fact, the petitioner filed Crl.M.P.No.622 of 2016 before the Sessions Court at Nagercoil, Kanyakumari District and obtained bail order on 23.02.2016.

Subsequently, the Sessions Court cancelled the bail by the order, dated 29.03.2016 in Crl.M.P.(MD)No.1110 of 2016 and thereafter, the petitioner was arrested on 06.06.2016 and now he is in judicial custody from that date. 4.The learned Government Advocate(crl.side) submitted that the petitioner is having two previous cases and investigation is pending. https://hcservices.ecourts.gov.in/hcservices/ 5.

and subsequently, he was arrested and remanded to judicial custody on 06.06.2016, this Court is inclined to enlarge the petitioner on bail with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Nagercoil, Kanyakumari District and on further condition that the petitioner shall stay at Vedasanthur and appear before the Vedasanthur police station daily twice at 10.00 a.m., and 5.00 p.m., until further orders. sd/- 15/06/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
