ORDER : The Court Made the following order :- The petitioner, who is arrayed as Accused No.1, apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b) and 506(ii) IPC and Section 12 of Tamil Nadu Protection of Children from Sexual Offence Act (TNPOCSO Act) in Crime No.241 of 2015, on the file of the respondent police and hence, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner had one side love with the daughter of the defacto complainant and due to the eve-teasing committed by the petitioner, the defacto complainant stopped to pursue her 11th Standard and thereafter also the petitioner along with other accused threatened the defacto complainant to arrange the marriage for the petitioner and his daughter. On complaint, a case has been registered against the petitioner for the above said offences.
3.The case of the petitioner is that he is an innocent and he has not committed any offence as alleged by the prosecution. 4.The learned Government Advocate (Criminal side) filed a status report and submitted that on 01.09.2015, the petitioner sent a letter to the defacto complainant stating some defamatory allegation against the daughter of the defacto complainant . He would further submit that the petitioner has to send for medical examination. Then only the prosecution side can be proved and the investigation is pending.

5.Considering the facts and circumstances of the case and also considering the serious nature of allegation made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner and this Criminal Original Petition is dismissed. sd/- 22/07/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
