Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 to 3, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Section 3 of TNPPDL Act, in Crime No.101 of 2016, on the file of the respondent police and hence, seek anticipatory bail. 2.The case of the prosecution is that due to civil dispute, the petitioners and other accused damaged the compound wall of the defacto complainant's farm. On complaint, case has been registered for the above said offences.

3.The case of the petitioners is that the petitioners are innocent and they have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. 4.The learned counsel for the petitioners submitted that petitioners are ready and willing to deposit a sum of Rs.5,000/- each. 5.Heard the learned Government Advocate (Crl.Side). 6.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners on condition that each petitioners shall deposit a sum of Rs.5,000/- (Rupees five thousand only) to the credit of Crime No.

101 of 2016, before the learned Judicial Magistrate, Sivagiri and on receipt of the same the petitioners are entitled to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Sivagiri and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.00 a.m., until further https://hcservices.ecourts.gov.

7. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
