Respondents PRAYER:Criminal Original Petition has been filed under Section 482 of Cr.P.C., praying to direct the respondents 2 and 3 to provide necessary police protection to the petitioner's life and limb by considering his representation, dated 30.01.2016 within the period that may be stipulated by this Court.

ORDER

It is an application seeking a direction to the respondent Nos.2 and 3 to provide Police protection to the petitioner's life and limb, based on his representation dated 30.01.2016. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents 1 to 3. By consent, the Criminal Original Petition itself is taken up for final disposal. In view of the limited prayer sought for by the petitioner, https://hcservices.ecourts.gov.in/hcservices/

this Court is of the view that notice need not be sent to the respondents 4 to 7.

3.The learned counsel for the petitioner would submit that in respect of a dispute regarding common pathway, the petitioner has filed a civil suit against the respondents 4 to 7 and obtained an interim order. As the respondents 4 to 7 abused him in filthy language and also gave a life threat to him, the petitioner has lodged a complaint, but the third respondent Police did not take any action. Hence, the petitioner has sent a representation dated 30.01.2016 to the second respondent Police, seeking to provide adequate Police protection to the life and limb of the petitioner. As there was no response to the same, the petitioner has come up with the aforesaid prayer.

4.The learned Government Advocate appearing for the official respondents, on instructions, would submit that the third respondent would consider the representation of the petitioner dated 30.01.2016 and pass appropriate orders on merits.

5.In view of the submission made by the learned Government Advocate, this Criminal Original Petition is disposed of with a direction to the third respondent to consider the representation of the petitioner, dated 30.01.2016 and after giving an opportunity of hearing to both the parties, pass appropriate orders on the same on merits and in accordance with law forthwith.

6.This Criminal Original Petition is accordingly disposed of.
