O R D E R

This petition is filed by the petitioner to direct the respondents 2 and 3 to grant permission to the petitioner for celebrating the Panguni Festival of Arulmigu Kaduvetti Karuppasamy temple, situated in Venkatasalapuram, Mahendravadi Village, Thiruvengadam Taluk, Tenkasi District, on 10.04.2025 to 12.04.2025, based on the representation, dated 01.04.2025.

2. The learned counsel for the petitioner would submit that the petitioner is one of the members of the villagers and they decided to conduct festival for the Arulmigu Kaduvetti Karuppasamy temple. Originally, the temple was constructed with the active steps of this grandfather and they have been conducting regular poojas and festival for the temple. For this year, the petitioner, being the poosari of the temple, decided to celebrate temple festival with the support of his family members and other villagers. The petitioner has been conducting the Page No. 2 of 6

Panguni festival in every year in the Tamil month of Panguni, followed with Pongal, Kida Vettuthal, Jama Poojai ceremony from the time immemorial. Due to some misunderstanding arose between the village people in conducting temple festival, the petitioner filed a suit in O.S.No. 119 of 2022, before the learned Principal District Munsif, Sankarankovil and the same is pending. Therefore, the petitioner sent a representation, dated 01.04.2025 to the respondents for conducting festival from 10.04.2025 to 12.04.2025 and for police protection and no any decision was taken. Therefore, he filed this petition.

The learned Additional Public Prosecutor (Crl side) for the respondent would submit that already, a opposite group filed a petition before this Court in W.P.(MD) No.9728 of 2025 and this Court directed the third respondent to consider the petitioner's representation, dated 27.03.2025 and 28.03.2025 and to take appropriate decision after affording opportunity to both the parties. While so, the petitioner filed this petition. Therefore, they will consider the representation of the petitioner and after affording opportunity to the parties, they take appropriate decision in accordance with law.

4. The learned counsel for the petitioner, by way of reply, would Page No. 3 of 6

submit that the petitioner requests to fix a time slot to celebrate the festival to the parties and he is ready to conduct festival within the time, which is to be allotted to this petitioner.

Considering the prayer sought for in this petition and the representation of the petitioner is pending with the third respondent and this Court also directed the third respondent to consider the representation of the opposite party, this Court directs the third respondent to consider the representation of the petitioner, after affording opportunity to both the parties without any delay and also the third respondent can allot time slot to the parties to celebrate festival.

6. With the above said directions and observations, this Writ Petition is disposed of.
