ORDER

The petitioner / A2, who was arrested and remanded to judicial 1/5

custody on 17.11.2025 for the offences punishable under Sections 87 of BNS, 2023 Section 3(a) r/w 4(2) of the Protection of Children from Sexual Offences Act, 2012, Section 5(m) r/w Section 6 of the Protection of Children from Sexual Offences Act, 2012, Section 351(3) of BNS, 2023, in Crime No.17 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the defacto complainant is the mother of the victim girl, who is aged about 7 years. The petitioner herein is said to have sexually abused the victim girl and on 16.11.2025, the same was informed by the victim girl to the defacto complainant and on enquiry, some bloods finds in her private part. Hence the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He would further submit that already there is a dispute with regard to the boundaries of their compound wall. Due to wreck vengeance, he was implicated in this case and the petitioner has been arrested and remanded 2/5

to judicial custody on 17.11.2025. Therefore, prayed to grant bail for the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent strongly opposed to grant bail to the petitioner on the ground that the offence committed by the accused is grave in nature and the age of the victim is 7 years.

5. This Court heard both sides and perused the materials available on record.

6. Considering the rival submissions made by the learned counsel on either side, nature of offence, and age of the victim girl and already this Court dismissed the earlier bail petition by considering all the aspects and there are no change of circumstance, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed. 3/5
