This Criminal Original Petition has been filed seeking a direction to the second respondent herein not to harass the petitioners in name of enquiry without due process of law.
2.According to the petitioners, there is a civil dispute pending between the petitioners and the third respondent and thereby, the third respondent lodged a complaint before the second respondent and the respondent police registered a case in Crime No.5 of 2024. Thereafter, the second respondent used to harass the petitioners in respect of the above said FIR and hence this petition.
3.The learned Counsel for the third respondent would submit that based on the complaint given by the third respondent, the case in Crime No.5 of 2024 has been registered and the same is under investigation. In the mean time, the petitioners filed this petition. Now, the third respondent died on 30.01.2025.
4.The learned Government Advocate (Crl.Side) appearing for the 2/5
respondent police would submit that based on the third respondent's complaint the said FIR has been registered against the petitioners and thereafter, during investigation, based on the confession statement given by the first accused, the respondent police have taken steps to recover the documents from the first petitioner. In the mean time, this petition has been filed and this Court also stayed the proceedings and the respondent police have not harassed the petitioners as alleged by the petitioners. 5.Considering the limited scope of the prayer sought for in this petition and the second respondent also denied the allegations leveled against him and stated that they have not harassed the petitioner and only for investigation purpose, based on the confession statement of the first accused, they called the petitioner, recording the same, this Criminal Original Petition is closed.
